Estate Planning

Estate Planning starts with empowering your loved ones to help care for you while you are still alive. A comprehensive estate plan should include all of the following documents:

  • Advanced Directives including a Living Will and Healthcare Power of Attorney

  • Financial Powers of Attorney

  • Simple, Complex, and Pour-Over wills

  • Revocable and Irrevocable Trusts

  • Special-Needs Trusts

  • Pet Trusts


Probate Administration

The process that follows the loss of a loved one can be complex. We will help guide you through the probate process and assist with:

  • Making sure that all of the financial and legal obligations are properly executed

  • Guiding you as the executor where there is a Last Will and Testament

  • Guiding you through the process of being appointed as the Administrator of the Estate if there is no will

  • Helping you navigate the Probate Court and relationships with other interested parties through intestacy

  • Helping you manage the additional complexities of having claims against the estate including those arising from litigation, private creditors, and Medicaid

  • Tas also has experience in matters regarding assets held internationally and can advise on taking steps including Apostille stamps and coordinating with consulates/embassies

  • Help you navigate insolvency if the overall debts outweigh the value of the assets.


Small Estate Administration

Not all estates require full administration depending on the total amount of assets and creditors. This can include estates with real estate and bank accounts. In Ohio the requirement if that there are fewer than $35,000 in assets or there are fewer than $100,000 in assets and the surviving spouse is entitled to all of the assets.

We will work with you to review your situation to determine if small estate administration is appropriate. Sometimes we will recommend a full administration even in the case of small estates due to the complexity of where the assets are located, if there are a large number of creditors, or if the estate is insolvent.



Probate & Trust Litigation

Not all estates and trusts are without dispute. Our goal is to help resolve disputes without litigation while recognizing that the death of a loved one brings an onslaught of financial and emotional burdens. However if an amicable resolution cannot be found, we will assist you in working through the legal system and use litigation to accomplish your goals regarding:

  • Will Contests

  • Trust Administration

  • Breach of Fiduciary Duty

  • Creditor Initiated Lawsuits
